The Right to Withdraw

Cancellation Instructions

As non-commercial customer you shall have the right to withdraw from the contract in writing within a period of two weeks and without stating any reason. The time limit begins after you have received this instruction but not before the conclusion of contract and not before we have fulfilled our obligations to provide information as defined in article 246 § 2 in conjunction with § 1 (1) and (2) of the Introductory Act to the Civil Code ("EGBGB") as well as our duties under § 312g (1) sentence 1 of the BGB in conjunction with Article 246 § 3 EGBGB. Punctual dispatch of the revocation suffices for observation of the revocation period. The notice of cancellation shall be addressed to:

The right to withdraw from the contract cannot be applied if the customer explicitely requires the immediate execution of the service (e.g. Domain registration, account opening, webspace activation) prior to the two weeks period or if the customer has initiated the services himself.

Consequences of Revocation

In the event of valid cancellation, the goods or services received by both parties must be returned and, where applicable, any accrued benefits (e.g., interest) surrendered. If the client cannot return to us the goods or services received (for example benefits from use), either in whole or in part, or can do so only in a deteriorated condition, then he must provide us, where applicable, with compensation. As a consequence of the latter, the client must comply with his contractual payment obligation for the period before the revocation. Obligations to refund must be achieved within 30 days. For the client, the period begins with the dispatch of the declaration of revocation, for us with its receipt.

Special Information

There is no right of revocation in the case of distance contracts for the delivery of goods made according to the customer specification or clearly tailored to personal needs or for service contracts which have been immediately fulfilled at the request of the customer or where the value of the service has already been received by the customer. The customer agrees that Key-Systems immediately excecutes the service after the contract has been concluded. The customer expressly consents that Key-Systems immediately fulfills its obligations regarding service contracts for domain names. The right to withdraw and the right to return is excluded completely for customers who are not consumers. Apart from that, we refer to our cancellation instructions.
